Terms of Service
These Terms of Service (“Terms”) govern your use of the website at vitalitylabs.ai and the iOS apps published by Vitality Labs LLC (“Vitality Labs”, “we”, “us”). By using our website or apps, you agree to these Terms.
Eligibility
You must be at least 13 years old to use our apps, or older if required by the applicable App Store age rating for a given app. By using an app, you represent that you meet this age requirement.
License to use the apps
Subject to these Terms and to Apple's standard Licensed Application End User License Agreement, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use our apps on iOS devices you own or control, for your own personal, non-commercial purposes. We reserve all rights not expressly granted.
Acceptable use
You agree not to:
- reverse engineer, decompile, or attempt to extract the source code of our apps, except where this restriction is prohibited by law;
- use our website or apps to violate any applicable law or regulation;
- interfere with or disrupt the integrity or performance of our website, apps, or related services;
- attempt to gain unauthorized access to our systems or to other users' data.
Accounts
Some apps may require you to create an account. You are responsible for keeping your credentials confidential and for activity that occurs under your account. Notify us promptly of any suspected unauthorized access.
Subscriptions and in-app purchases
Some apps may offer paid subscriptions, in-app purchases, or other paid features. These are processed through the Apple App Store and are subject to Apple's terms. Cancellations and refunds are handled through your Apple ID account settings.
Your content
If an app lets you create content — notes, settings, entries, photos, recordings, or anything else — you retain ownership. To the extent we need to host, store, process, transmit, or display that content to provide the features you use, you grant us a non-exclusive, worldwide, royalty-free license to do so. How we handle your content is described in our privacy policy.
Health and wellness disclaimer
Our apps are general wellness and informational tools. They are not medical devices, and they are not intended to diagnose, treat, cure, or prevent any disease or health condition. Information shown in our apps — including scores, summaries, and citations to scientific research — is for general informational purposes only and is not medical advice.
Always seek the advice of a qualified healthcare professional with any questions you may have about a medical condition or a change in your activity. Do not disregard professional medical advice or delay seeking it because of something you read in one of our apps.
No warranties
Our website and apps are provided “as is” and “as available”, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Vitality Labs disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the apps will be uninterrupted, error-free, or that any defects will be corrected.
Limitation of liability
To the fullest extent permitted by law, Vitality Labs and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of our website or apps. Our total liability for any claim arising out of or related to these Terms or our apps will not exceed the greater of (a) the amount you paid us for the app giving rise to the claim in the twelve months before the claim arose, or (b) US $20.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
Third-party services
Our apps are distributed through Apple's App Store and rely on services provided by Apple, including HealthKit on Apple devices. Your use of those services is governed by Apple's terms and privacy policies, in addition to these Terms.
Governing law and venue
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our apps will be resolved exclusively in the state or federal courts located in Spokane County, Washington, and you consent to personal jurisdiction in those courts.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above. Your continued use of our website or apps after a change takes effect constitutes your acceptance of the updated Terms.
